Col Ndahura’s wife petitions court

KAMPALA- The family of the jailed former director of police Crime Intelligence, Col Atwooki Ndahura, has petitioned the High Court to order the Chief of Military Intelligence (CMI ) and the Attorney General (AG) to have him produced in court immediately.

Through Ochienge Associated Advocates, Col Ndahura’s family filed a habeas corpus application [order for production of the accused] in court yesterday.

Col Ndahura was arrested at Peace Corner Motel in Masindi Town On June 11.

The AG, CMI, Inspector General of Police (IGP) and the Chief of Defence Forces (CDF) are named as the respondents in the application. Col Ndahura’s wife Sarah Ndahura is named as the applicant.

In an affidavit, Ms Ndahura said her husband has been unjustly deprived of his personal liberty contrary to Article 23 (6) (a) of the Constitution.

She asserts that Col Ndahura is being held incommunicado and has not been produced or charged in any court of competent jurisdiction nor has his family, lawyers and doctors been allowed access to him.

“On June 15 at around 10am, my lawyers, our family doctor and I went to Makindye Military Barracks to see [Col Ndahura]. However we were denied entry and we were asked to return the following day,” Ms Ndahura’s affidavit reads in part.

“Later in the afternoon on the same day, a group of military personnel came to my home in Nansana in Wakiso and turned the house upside down confiscating my phones and no family member was allowed to talk to him,” she further states.
Ms Ndahura avers that her lawyers informed her that the soldiers manning the military barracks entrance said access to Col Ndahura was suspended until further notice.

“I am advised by my lawyers whose advice I verily believe to be true that this court has powers to grant the reliefs sought and also to summon the IGP, CMI and CDF to explain the whereabouts of Col Ndahura. I believe the life of Col Ndahura is in danger unless court intervenes,” the wife states.

She is seeking a compensation of Shs200m plus any damages the court may consider appropriate.
Col Ndahura is among the 26 people, including police and military officers, who have been arrested and implicated in criminal activities during the 12 years of the controversial reign of former Inspector General of Police Gen Kale Kayihura, who is currently in detention in Makindye Military Barracks.
