Court orders Kigo prison to produce MP Kabaziguruka

Kampala.

The High Court in Kampala yesterday ordered Kigo prison to produce Nakawa MP Michael Kabaziguruka to attend the hearing of his petition in which he is challenging his treason trial in the General Court Martial.

Justice Patricia Basaza Wasswa issued the production warrant upon a submission by Mr Kabaziguruka’s lawyer, Mr Ladislaus Rwakafuuzi, that it was important for the MP to be in court to participate in his case.

“We failed to extract a production warrant because the state had to file their reply to Kabaziguruka’s petition in court, but since they have done so, we seek that he be present in court to hear his case,” Mr Rwakafuuzi said.

Previously
Last month, Mr Kabaziguruka petitioned the High Court to quash his trial in the General Court Martial at Makindye, saying he is a civilian and not subject to military law.

He said his right to a free and fair trial would be jeopardised in the army court, which he said is not independent, but works on the direction and control of the President.

Mr Kabaziguruka and 22 others are alleged to have contrived a plot to overthrow the government of Uganda between February and June this year.
