Court clears maid over sex with boy aged 2

KAMPALA. The High Court in Kampala has released a housemaid who was accused of having sex with her boss’s two-year-old boy and performing other sexual acts on the toddler.
Florence Komuhangi was on Thursday freed by High Court Judge Wilson Masalu Musene who ruled that there was no evidence to prove the accused committed the alleged offence.
"In this present case Komuhangi is accused of sucking the boy's penis and inserting it in her womanhood. The only person who saw this happening is her sister. However from her testimony it is not clear whether she saw the accused doing so," the judge noted, adding that the victim was still too young to testify in court.
Justice Musene also noted that the young girl's evidence lacked corroboration which would have been done by their mother Mariam Nakuya but she only told court that she was told by her son that his penis was paining and she did not check him until some days after the maid had been chased away.
"This court finds it strange. However tired a mother is, she cannot fail to check on their children when told they are in pain," Justice Musene observed.
Prosecution had stated that Komuhangi who was aged 19 at the time of the alleged offence in July 2013 at Mutundwe zone 1, Rubaga division in Kampala district performed a sexual act with a boy aged two.
The judge noted that the only corroborating evidence was of the police surgeon's report that indicated that the boy had a normal circumcised penis with no discharge.... It would be unfair for this court to convict you (Komuhangi) on uncorroborated evidence. I therefore set you free unless charged with other offences," Justice Musene ruled.
