Lawyer Kasango theft sentence set for today

KAMPALA- Buganda Road Chief Magistrate’s Court will today sentence city lawyer Bob Kasango, who was recently convicted of stealing more than Shs3 billion.

The money in question belonged to Tooro Queen Mother Best Kemigisa who entrusted Mr Kasango with the duty of receiving it from the Lands Ministry Permanent Secretary on her behalf.

Mr Kasango’s February, 2015 order of acquittal was this month set aside by Justice Elizabeth Kabanda and substituted with a conviction on two counts of uttering a false document contrary to Section 351 of the Penal Code Act and count three of stealing by agent.

Justice Kabanda upon convicting Mr Kasango on State appeal ordered that the record of proceeding in the Chief Magistrate’s Court be referred to Magistrate Jamson Karemani for sentencing.

Last Thursday during mitigation to cause a harsh sentence for the convict State prosecutor Jonathan Muwaganya said the State would be pleased for the accused to be jailed for a maximum sentence of 14 years.

“We implore court to consider that the action of the convict have greatly affected the complainant (Ms Kemigisa) as she has been deprived the right to use her money for about eight years. She has as well invested a lot in assigning private lawyers and foot transport bills,” Mr Muwaganya said.

“…prosecution feels the option of a fine will not be reasonable basing on the anticipation of the convict. They as well pray for specific order of compensation of the sum stolen with an exact timeline within which, the order should take effect and specific remedies once the timeline is not observed,” he added.

In response the prosecutor’s argument Kasango maintained that he is an innocent man, and has already appealed against the High Court decision.
