Makindye court formally halts Kayihura prosecution

Makindye Chief Magistrates’ Court has formally halted the torture case against the Inspector General of Police, Gen Kale Kayihura.

In a court session that lasted 12 minutes only, lawyer David Oundo Wandera, who called himself an officer of the court, presented to the court a copy of Justice Kavuma’s interim order as a basis for the court to halt the criminal proceedings.

Mr Wandera explained to court that in light of Justice Kavuma’s interim order, it was prudent that the court halts the proceedings against the IGP until the Constitutional Court hears and determines the main petition challenging his prosecution.

On Friday last week, Justice Kavuma upon being moved by the petitioner, Mr Robert Rutaro, a city lawyer and former Makerere University guild president, issued an interim order by immediately stopping Gen Kayihura prosecution before Makindye court.

To that effect, presiding magistrate Nakitende halted the proceedings against Gen Kayihura until further notice when the Constitutional Court determines the main petition challenging Kayihura prosecution.

“A copy of the interim order was received by this court on this August 29, and this court accordingly adjourns this matter indefinitely..” Magistrate Nakitende ruled

Unlike in the previous court session of August 10 that was chaotic as a group of pro-Kayihura supporters staged a huge demonstration at court that was aimed at disrupting the proceedings, this time round, the atmosphere was calm.
