Man aged 73 jailed 15 years for defilement

The High Court in Mukono on Monday sentenced a 73-year-old man to prison for defiling a six-year-old girl.
Prosecution states that on July 4, 2016, Moses Mutumba, a resident of Kyikondo village, Namagunga-Nagojje Sub-county in Mukono district defiled a neighbour’s kid.
The victim’s mother had sent her to buy some items at the shops and on the way back, Mutumba asked her to go to his house. He then laid her on a mat in his house and had sexual intercourse with her.
Prosecution submitted during the trial that Mutumba had premeditated intention to commit the crime since he lured the girl to his place and prepared a mat on which he defiled her.
Mutumba told court that the victim had already had her hymen ruptured because she was already involved in sexual acts with other people and therefore he could not have caused her big damage.
The trial judge Margret Mutonyi observed that Mutumba, a casual worker, admitted to having defiled the victim but wasn’t remorseful about his act. The judge said the accused instead insisted he found the girl already “wide” and used to have sex so he didn’t damage her so much. The judge reasoned that Mutumba’s conduct was disgusting and embarrassing since he is fit to be the grandfather of the girl.
Justice Mutonyi said the offence attracts up to a sentence of death or life imprisonment but because Mutumba pleaded guilty and did not waste court’s time and given his advanced age, he would be condemned to 15 years in prison in order to protect other children and society from him.
