Registrar disqualifies self from hearing Muhwezi land eviction case

KAMPALA. Deputy registrar of the Executions Division of the High Court, Mr Deo Nzeyimana, last evening disqualified himself from hearing an application in which former health Minister, Maj Gen Jim Muhwezi is seeking to be reinstated on his city land following his forceful eviction by court bailiffs last week.

The application for stay of his further eviction, had been scheduled for hearing on Wednesday, but registrar Nzeyimana told the parties involved that he has a conflict of interest since he knows Mr William Hitmana, one of the parties involved in the case.

Mr Hitmana is believed to have sold the contentious one acre piece of land to Maj Gen Muhwezi in 1995.

The land is located along Salaama Road in Makindye Division, Kampala.

With the consent of the lawyers of both parties, the file was allocated to Justice Paul Gadenya, who promised to hear the application on May 16.

In his application, Maj Gen Muhwezi states that he had been enjoying his quiet/peaceful occupation of the said land for the last 23 years until last week when court bailiffs tried to evict him on instructions of Mr James Mubiru.

Last week, he was violently evicted from the said land in Makindye by court bailiffs despite making numerous calls to police as they did not come to his rescue.

His desperate attempts to stop the eviction by calling the Inspector General of Police, Martins Okoth-Ochola were futile as he was not reachable at the time.

The former minister then turned to the Katwe Division Police Commander ASP Kato Mugira Yeko, but his move was met with further frustration, leaving the court bailiffs to demolish the property on the contested land.

The police commander said he was complying with a court order to remove Mr Hitimana from the land and reinstate Mr Mubiru as the owner.

But through his lawyer, Mr Ahmed Mukasa Kalule, Muhwezi filed for a stay of execution in a bid to reclaim the contested land.
