Kampala- The management of Forest Mall has closed the main branch of Select Garments shop at the building over $200,000 (aboutShs520m) in rent arrears.

Mr Stanley Isiagi, the managing director of Old Stanely Hotel, which manages the mall, said they were forced to close the shop last weekend because of a disagreement with Mr Robert Ahimbisibwe, the Select Garments managing director, after he refused to pay costs of a suit he lost over the same money.

“Last year, we were in the Commercial Court over the same matter and the court ruled in our favour but when we asked him to pay the money, he refused, saying he will double the amount we have spent on the suit so that he does not pay the money[rent] but continues occupying the shop,” Mr Isiagi said.

However, Mr Ahimbisibwe accused the landlord of defying two court orders (copies of which Daily Monitor obtained) restraining them from denying him access to the shop pending the hearing of an appeal.

“I have two court orders restraining them from closing the shop or denying me access but they have gone ahead to close my shop even before court disposes the case,” he said.

According to the order, Mr Isiagi was blocked from evicting the applicant pending the hearing and determination of the application on June 25 and another issued out on July 11, that maintained the status quo.

When contacted, Mr Richard Omongole, the lawyer representing the hotel, claimed the court orders had expired and Select Garments did not renew them.
