Three jailed for raping drunken HIV-positive woman
KAMPALA- City Hall Magistrate’s Court has remanded three men accused of gang-raping a drunken woman.
The charges were read out to the three suspects; Robert Mucunguzi (29), a butcher, Eric Ahishakye (21) a saloon operator and Ian Aine (26), all residents of Kikulu zone in Kasaasi suburb, Kampala. They were not allowed to make any plea because rape, being a capital offence, a magistrate’s court has no jurisdiction to hear it.
“You shall not take plea because this is a capital offence that can only be heard in the High Court. However, you have a right to apply for bail in the High Court,” Grade One Magistrate Esther Nahirya told the accused before remanding them to Luzira Prison on Tuesday.
The state was represented by prosecutor Ms Jackie Kyasimire.
Prosecution stated that the trio, on June 28, 2017 about 9:00pm at Kikulu Zone in Kisaasi, had sexual intercourse with a drunken woman without her consent. According to documents submitted in court, the victim is HIV-positive and infected all the three suspects with the virus that causes AIDS.
In the same court, an 18-year-old housemaid was remanded to Luzira Prison on charges of infecting her boss’ two-year old toddler with HIV.
Jemima Nasifah alias Tumukunde Zainabu, a Rwandan denied the offence of performing a negligent act likely to spread an infection or disease.
Prosecution states that between June 30 and July 3, 2017 at Kiwatule, Kazinga zone in Kampala, Nasifah knowingly or having reason to believe that she was HIV positive cut herself on the right hand and put her blood on the baby’s open wound around the nose.
Court also heard that Nasifah was caught red-handed in the act after the victim’s mother heard the baby crying.
According to the court documents the banana leaves that were meant to be used for cooking food were found all spread with Nasifah’s blood.
