What some sections of the Anti-Pornography Bill say
Definition of Pornography:
Any cultural practice, radio or television program, writing, publication, advertisement, broadcast, upload on the Internet, display, entertainment, music, dance, picture, audio or video recording, show or exhibition or any combination of the preceding that depicts
a) A person engaged in explicit sexual activities or conduct,
b) sexual parts of a person such as breasts, thighs, buttocks or genitalia,
c) Erotic behaviour intended to cause sexual excitement or
d) Any indecent act or behaviour tending to corrupt morals.
Child Pornography
Clause 14: A person commits an offence if he or she produces or participates in the production of or traffics or publishes or broadcasts or procures or imports or exports or in any way abets pornography depicting images of children (below the age of 18).
* Punishable- Shs15 million or imprisonment for 15 years or both.
Clause 12: A person who produces or participates in the production of, or traffics in, or publishes or broadcasts or procures or imports or exports or in any way abets pornography commits an offence and is liable on conviction to a fine of about shs10 million or imprisonment two years or both
Clause 15: Where information in brought to the attention of court that there exists in premises, an object or material containing pornography or an act or event of pornographic nature, the court may issues a seizure warrant for the object or material and an arrest warrant for the person promoting and arrest warrant for
* A person who obstructs an authorised person in the carrying inspecting the premises or seizing the pornographic objects commits an offence and is liable to a fine of Shs500,000 or five years in jail or both.
Clause 16: The committee, the court or a police officer not below the rank of superintendent of police, may, in writing, direct any newspaper, publisher, broadcaster, proprietor of any business dealing in computers, telephones or other medium for transmitting electronic information or the proprietor of any place or business dealing in leisure or entertainment, bookshop owner, dealer in photography, newsprint or magazine dealer or vendor, importer or other person to desist from dealing in pornography.
* Punishment a fine of shs500, 000
Clause 17: Any Internet service provider who indulges in pornography commits a crime punishable by shs1million or five years in jail or both and court may order his business to be closed.
* Failure to comply with the court order to close the business will earn you a Shs500, 000 fine or five years in jail.
Clause 18: Where a proprietor of a place of leisure or entertainment or of a business dealing in leisure or entertainment commits a pornography crime for a second time under this act, court may issue an order suspending or prohibiting the offender from dealing in leisure or entertainment.
* Failing to comply with the court order is criminal attracting a jail punishment or a fine not exceeding Shs500,000 or both.
Clause 24: The committee shall maintain a register of pornographic offenders and it will be part of the report to be annually tabled in parliament.
