40-year-old man pinned over defiling two siblings

A 9-year-old girl has narrated to court how a 40-year-old man defiled her and her sister on the same day.

The juvenile who did not physically appear in the courtroom but had her testimony relayed via a video link while seated in the judge's chambers was also able to identify Justus Nuwagaba as the man who defiled them on January 1, 2017 after his face was displayed on her screen on Thursday.

The victim who was only six at the time of the offence told Kampala High Court judge Jane Francis Abodo that on the fateful day, Nuwagaba who was a regular customer at their mother's shop in Mutungo Biina in Nakawa Division went to the shop and coninced the girl and her then nine-year-old sister to visit his aunt who was reportedly at his home.

The victim stated that when they reached his home, Nuwagaba whom they had known for long opened the house and invited them in.
However, there was no one else in the house yet Nuwagaba had claimed his aunt was waiting for the two girls. He instead allegedly switched on the television and asked them to watch with him.

Nuwagaba allegedly defiled the two sisters in turns in his bathroom.
The victim further revealed that when she came out of the bathroom, they ran out of Nuwagaba’s house before they reported to their mother who in turn reported to police leading to his arrest.
A medical report presented in court also indicated that the girl had bruises in her vagina while her sister had a raptured hymen as a result of penetration.

However, her sister could not appear in court to testify because she is a primary seven candidate and prosecution feared that her presence could traumatize her in this critical period of preparation for her Primary Leaving Exams (PLE).
Hearing of the case was adjourned until the other victim finishes her final exams when she will be required to give her testimony. The suspect was also further remanded to Luzira Prison on two counts of aggravated defilement.
