Case in which student is accused of sending love messages to MP deferred

The hearing of a case in which a 25-year-old student of YMCA-Jinja branch, is charged with cyber harassment and offensive communication against Kabarole District Woman MP Sylvia Rwabwoogo has been deferred.

The accused, Brian Isiko on Friday showed up at court but the hearing could not kick off because the trial magistrate is away on a trip in the US.

Court heard from the state prosecutor, Ms Miriam Njuki that Ms Rwabwoogo who was present in court was also ready to testify.

The presiding magistrate, Ms Ketty Joan Acaa adjourned the case to November 23 for hearing by the trial magistrate when she returns from her trip.

It’s alleged that between November 2017 and June 2018 at unknown location in Kampala, Isiko used a computer to send love messages, which were obscene, rude, lustful or indecent to the person of Ms Rwabwoogo and using SMS messages he repeatedly attempted to disturb the peace or right to privacy of Ms Rwabwoogo without a legitimate purpose.

Isiko had initially been convicted and sentenced to two years in prison. He successfully appealed against the sentence and conviction on grounds that the first trial magistrate, Ms Gladys Kamasanyu erroneously convicted and sentenced him.

Subsequently, the High Court quashed Isiko’s earlier conviction before ordering that his file be remitted to Buganda Road Chief Magistrate’s Court for a retrial before different magistrate.
