Court gives city socialite Bryan White 10 days to defend self

What you need to know:

  • Mr Alex Binyenda’s (complainant) lawyer, Mr Anthony Wameli denied ever impounding or having any problem transferring the names of the car to Mr Kirumira’s names.

Court has given socialite Brian Kirumira alias Bryan White 10 days to file his defence on allegations of failing to pay $160,000 (about Shs591,406,000) for a car in his possession.

The case had come up for hearing of an application for leave to appear and defend himself (Mr Kirumira) before the High Court Commercial Division. Mr Kirumira, through his lawyer Mr John Bulungu, raised concerns that the car in question is not in his names and the price was way higher than what it was supposed to be sold at.
“My lord, my client does not even have the car. It was impounded by the complainant who is also the seller thus we seek for leave of court to file our defence,” Mr Bulungu said.

However Mr Alex Binyenda’s (complainant) lawyer, Mr Anthony Wameli denied ever impounding or having any problem transferring the names of the car to Mr Kirumira’s names.

In his main case, Mr Binyenda claims that on May 15, 2018, the defendant (Kirumira) by agreement purchased his motor vehicle Registration No. UBA 063 J, Mercedes Benz at a total of over Shs900million.

He says that the defendant paid cash of over Shs300 million leaving a balance of over Shs500 million and immediately upon executing the said agreement, Kirumira took possession of the car and has been using it.
“After some time, the plaintiff kept demanding for the balance from the defendant but he kept dodging and hiding from him,” reads in part Binyenda’s claim.

Binyenda claims that, despite several demands, the defendant has refused, failed or neglected to pay his balance of over Shs500million and as a result he has been deprived of his right to have and use his money.

He contends that the defendant’s actions amount to breach of contract for which he is liable to pay him the outstanding balance of about Shs500 million, interest on the said amount at a rate of 25 per cent per annum from May 22, 2018 till payment in full is completed, and the costs of the suit.
