Luweero father given 13 years in jail for defiling, impregnating own daughter

A 33-year-old man in Luweero District will spend 13 years in jail for defiling and impregnating his own daughter in a case settled under the judicial plea bargain Court process.

Charles Minaani, a resident of Kidolindo village, Kibanyi parish Bamunanika Sub-county in Luweero District while appearing before High Court Judge Vincent Tonny Okwang through his defence lawyer Mr Deo Kizito opted for the plea bargain Court process after pleading guilty to the offence of defiling his own 12-year-old daughter.
State Prosecutor Ms Beatrice Alok Odong told Court that Minaani committed the offence on August 11, 2016 at his home located in Bamunanika Sub County centrally to Section 129 of the Penal Code Act. He was charged with aggravated defilement.

“I have voluntarily agreed to serve a prison sentence of 13 years on guilty plea charge of aggravated defilement,” reads a statement in the plea bargain agreement signed by the convict during the High Court Session before Justice Okwang in Luweero on January 13, 2020.
A close relative who did not want her names mentioned claimed that they had forgiven Minaani.

“We could not imagine that such an incident could happen in our family. We forgave Minaani but the law had its own guidelines that we followed,” he said.
Under the Plea Bargain Judicial process, the defendant agrees to plead guilty voluntarily in exchange for an agreement where he expects to have a lesser sentence in a criminal case, skipping the lengthy Court trial process that could attract a tougher penalty once the defendant loses the case. The process is optional, Justice Okwang explains.
