Three families claim same city land

Kampala. Another family has petitioned the Commission of Inquiry into Land Matters seeking to repossess 25 acres in Kagugube Parish in Makerere area.
The family of the late Misusera Kamya Mukaabya claims that Dr Emmanuel Lumu, the former Health minister, aged 102, encroached on their land.
Dr Lumu has 10 plots on the land the family of the late Mukaabya is claiming in Kagugube. The family says Dr Lumu has since sold some of the plots to different people, including Ms Gladys Mukula.
The 10 plots in the name of Dr Lumu had earlier been claimed by Ms Rosemary Nabukenya,78, who claimed she inherited the land from her mother.
However, appearing before the land probe on Tuesday, Mukaabya’s family refuted both Dr Lumu and Ms Nabukenya’s claim on the land.
Mr George Sendege, 94, told the land probe on Tuesday that his grandfather, the late Mukaabya, was given the land by Kabaka Chwa in 1922.
“This land was given to my grandfather in appreciation for his role in drafting the 1900 agreement. That is is why that land was first registered in his names,” Mr Sendege testified.
According to the family, some of the people who have encroached on their land include Dr Lumu, Nnalongo Louisa Nanyonga, Dr Aggrey Kiyingi (Dehezi International building) and Mukwano.
Other claimants are Uganda People’s Defence Forces (UPDF) who bought the land from the late Dr Kisekka (the land now hosts army hospital), Victoria Car Bond, Children’s Park, Police, Kampala Capital City Authority, Ms Mukula and the late former Kampala mayor John Ssebaana Kizito.
Mr Sendege and Asuman Kizito Bawalekedi, Aron Namutebi and Florence Nakigudde are the administrators of the late Mukaabya’s estate, which had not had an administrator from 1944, when the heir died, until 2002 when the four were appointed administrators.

‘Awoken’
When commissioner Rose Nakayi asked Mr Sendege why the family allowed all these transactions on the land take place without their intervention, Mr Sendege said they were “asleep” but they have “woken up.”
Mr Sendege is a resident of Kamira in Nakifuma, Mukono District.
Apart from their own testimony claiming the genealogy with Mukaabya, the family had nothing to show they were related to the deceased who died without having a biological child.
When asked whether he knew Eriab Nsubuga, the person said to have sold Block 9 Plot 351 – 360 to Nnalongo Louisa Nanyonga for Shs250,000, Mr Sendege said he was their relative.
The probe chairperson, Justice Catherine Bamugemereire, asked the family to return with proper documents to prove ownership of the land.
The commission is investigating ownership of Block 9 Plot 351–360 that was transferred to Nanyonga Louisa Nnalongo as of April 15, 1961.
Last week, Ms Nabukenya of Makerere-Kagugube zone, accused Dr Lumu of stealing documents of the contested land from her mother Nanyonga before and selling it off.
Dr Lumu appeared before the probe on Tuesday to explain how he acquired the land, but he could not speak due to his advanced age.
