Posta bus impounded over Shs36m debt

Rubanda- A Posta Limited bus has been impounded by court bailiffs over the company’s failure to pay Shs36.7m after losing a civil case in the chief magistrate’s court in Mbarara.

A Post bus registration number UAP 731U, knocked and damaged a vehicle of Mr John B Kabandize of BKA Advocates on the Mbarara –Ntungamo road in 2015. Mr Kabandize filed a suit at Mbarara Chief magistrate’s court against Uganda Posta Limited, Centenary Bank Limited and Mr Tony Anganya, the driver of the bus.

The court ruled in favour of Mr Kabandize, asking Centenary Bank Ltd, Uganda Posta Ltd and Mr Anganya to pay Mr Kabandize special damages of Shs17,430,000, general damages of Shs2,500,000 and costs of the suit to the plaintiff of Shs16,780,000, which they failed to pay.

On July 5, the chief magistrate’s court issued an order instructing Mr Benjamin Mujuni to attach a movable property of the defendants for public auctioning for refusal to pay the money.

On Tuesday, Mr Mujuni trailed Post bus from Kampala to Kisoro and seized it from Mbarara town near Mbarara Central Police Station. It was impounded and taken to Mbarara court premises for public auctioning.

In Mr Mujuni’s July 12 letter to the chief magistrate’s court, he confirms attaching the bus belonging to the defendant as per court order. Mujuni also confirms possession of the property.
