Police move to evict Muhangi family as bus park row continues

KAMPALA- Police have been directed to evict the family of the deceased Kampala businessman Charles Muhangi four months after the office of the Solicitor General gave an order evicting Drake Lubega and his agents from plots 43 to 47 on Nakivubo Road.
On Tuesday, Police Director Legal Affairs, Mr Erasmus Twaruhuka wrote to the Commander Kampala Metropolitan to evict the late Muhangi’s family from the property.

“The purpose of this communication is to relay position of the matter which is that Lubega should be in possession of the premises in question as the matter of ownership awaits court’s jurisdiction. The matter therefore is to instruct that you ensure that possession of the premises returns to Mr Lubega. Any property that is aggrieved by this decision is advised to seek court redress,” Mr Twaruhuraka wrote.
Mr Twaruhuka says the police eviction order is based on the earlier opinions given by the successive Attorney Generals and Deputy Attorney Generals between 2014 and 2017.

He says that the Speaker of Parliament Rebecca Kadaga had also written to police about the issue.
“Further reference is also made to a meeting held in the Attorney General’s Chambers today, February 19, after the receipt of a letter Ref. AB/99/1999/10 dated January 23 from the Speaker of Parliament over the same subject. In the meeting the Deputy Attorney General and myself were in attendance,” Mr Twaruhuka writes.

The Supreme Court was supposed to give its ruling tomorrow (Thursday) after Muhangi’s son, Lionel Muhangi went to court seeking repossession of the properties he co-owned with his father under Horizons Coaches Ltd.
On January 29 and February 14, the parties met in the chambers of the Attorney General and the State House Head of legal to solve the property wrangle but failed.

Anne Mugisha, the mother of Lionel Muhangi said: “Dead men do not talk and cannot defend themselves that is why we expect to step government to step in to protect their rights. Instead we see government perpetuating fraud. This cannot stand in law,” she said.
