Lukwago asks to join case on abolition of city political offices

Kampala. Kampala Lord Mayor Erias Lukwago yesterday petitioned the Constitutional Court, seeking to be added as a party to the petition that is seeking to abolish the various political offices in the city.
Mr Lukwago, in his application, wants the court headed by Deputy Chief Justice Steven Kavuma to delay delivering the judgment in the petition filed by Mr Mulindwa Muwonge against the Attorney General until his argument is also heard.
Justifying his decision to join the case, the Lord Mayor says the orders of the court may gravely affect him and as such, he will be condemned unheard.
“As an elected leader of Kampala, I have sufficient interest in this matter and some of the orders being sought in the petition such as abolishing the offices of the Lord Mayor, division mayors and eliminating the local government system in Kampala will definitely impact on my rights, including the possibility of losing my seat as elected Lord Mayor…,” Mr Lukwago’s petition reads in part.
His application comes days after the court concluded the hearing of the petition challenging the existence of political offices in the city which is now pending judgment at a date yet to be fixed.
Mr Muwonge, in his petition, contends that section 6 of the KCCA Act, 2010, which provides the Authority as the governing body of the capital city composed of locally elected councillors and the Lord Mayor, is in contravention of and inconsistent with articles 5 (4), 2 (1) and 2 (2) of the Constitution that provides for the administration of the capital city by the central government thus eliminating the local governance structure in the city.
The petitioner also contends that sections 27, 38 and 40 of the KCCA Act, 2010, which provide for the lower division, ward and village urban councils, are inconsistent with the Constitution which provides for the administration of the capital city by the central government thus eliminating the local government structure.
By press time, the court had not yet fixed the date for hearing Mr Lukwago’s application.
