Court sets December 9 for Bagyenda murder case

KAMPALA- Court has set December 9 for the hearing of the murder case against Brian Bagyenda who is accused of killing his girlfriend.

Justice Moses Kasirye set the date after the prosecution submitted to be allowed to present his witness after the defence lawyer failed to strike a plea bargain settlement for his client.

Plea Bargain is a justice system where an accused admits the alleged offence and negotiates with the prosecution for a lenient sentence on conviction.

It generally saves material resources and time the prosecution and court would have spent on gathering and evaluating evidence during the trial.

On Tuesday, the court read the charge of murder against Bagyenda and he pleaded not guilty.

The accused’s defence lawyer, Mr Nsubuga Mubiru had earlier told court that Bagyenda suffers from a mental disability and before committing the offence, he was a mental patient at Butabika Hospital. The lawyers sought to have medical findings on his mental status at the time of the murder, which would guide them in the plea bargain negotiations with the prosecution.

Prosecution alleges that on January 4, 2017 at Njobe Road in Nakawa Division, Kampala District, Bagyenda with his two accomplices Innocent Bainomugisha and Vincent Rwahwire, killed his girlfriend, a one Twijukye who was a student at Ndejje University.

According to the prosecution, Bagyenda confessed to killing Twijukye in his home in Luzira upon suspicion that she had an affair with another man.
