MP Mugoya sued over botched Shs1b land deal

Kampala. The Member of Parliament for Bukooli North, Bugiri District, Mr Gaster Kyawa Mugoya, has been sued by a real estate dealer seeking recovery of Shs1.2b.

The money was allegedly lost in two botched land deals. Mr Patel Ranchodbhai Chimanbhai, a real estate dealer, accuses Mr Mugoya, a former magistrate, of breach of contract.

In one of the suits filed before the Commercial Division of the High Court, Mr Mugoya is sued together with Mr Hamad Senyonga.
The land in question was purchased on June 2, 2008 and is comprised in Kibuga Block 2 plot 144, situated at Bukesa-Namirembe in Kampala.

Mr Chimanbhai wants the duo to pay $175,789, special damages of Shs28.2m, interest, general damages and costs of the suit.

Through his lawyers Paul Sebunya & Co Advocates, Mr Chimanbhai claims that he received a special certificate of title and duly signed transfer forms from the defendants and later processed a transfer of the land into his name.

On June 13, 2008, he claims, he was registered as the proprietor of the land on special certificate of vide instrument no. KLA378261 one in the names of the second defendant.

“…that he was in May 2008, invited by officers at the Criminal Investigations Department at Kibuli where they interrogated and made to write a police statement on how he purchased the said land.

On the same day, the plaintiff was told by the officers at the Criminal Investigations Department that the defendants were being suspected of being involved in fraudulent dealing concerning the said property,” documents before court read in part.
