Plea bargain delays Kaka son’s trial

kampala. The hearing of the murder case against Mr Brian Bagyenda failed to take off yesterday after defence lawyers told court they had not concluded their preparations to seek plea bargain.

“I was with the Director of Public Prosecutions (DPP) this morning and we are about to finalise with our talks. One week adjournment will be enough for us to do so,” defence lawyer Nsubuga Mubiru submitted.

Plea bargain is a justice system where an accused admits the alleged offence and negotiates with prosecution for a lenient sentence.
In the last court appearance, Mr Bagyenda’s lawyer said his client suffers from a mental disability and before committing the offence he was a mental patient at Butabika hospital.

The lawyers sought to have medical findings on his mental status at the time of the murder, which would guide them in the plea bargain negotiations with the prosecution.

The trial judge Anthony Ojok Ayu of the High Court gave the lawyers up to January 21 conclude their processes.

The prosecution states that on January 4, 2017, Bagyenda with his two accomplices murdered his girlfriend Enid Twijukye.
According to the prosecution: “Bagyenda confessed to killing Twijukye in his home in Luzira upon suspicion that she had an affair with another man.
